Protecting DMK, not RSS? Madras HC questions Tamil Nadu police over biased stand

Justice Jayachandran of the Madras HC emphasized that permission should be granted with conditions and should not be denied in the future without valid reasons. The court also stated that permission cannot be rejected solely based on the presence of places of worship or offices of parties with alternative policies.

Chennai: The Madras High Court has intervened in a dispute between the Rashtriya Swayamsevak Sangh (RSS) and the Tamil Nadu police over permission to hold route marches and public meetings on Vijayadashami. Justice G. Jayachandran directed the police to consider the RSS’s application, citing last year’s guidelines issued by the court.

The RSS had sought permission for 58 locations, but the police granted permission for only 52, citing reasons such as metro rail works, traffic congestion, and the Dussehra festival for rejecting the remaining six. The rejected locations include Chennai Mangadu, Koratur, and Coimbatore Ratnagiri.

RSS March Controversy: Madras HC Takes on Police

Justice Jayachandran emphasized that permission should be granted with conditions and should not be denied in the future without valid reasons. The court also stated that permission cannot be rejected solely based on the presence of places of worship or offices of parties with alternative policies.

The judge questioned the police’s decision to reject permission in some areas, pointing out that security was provided for the DMK coral festival program on the same day. “Let’s not test the patience of the court in this matter,” Justice Jayachandran said, highlighting the need for fair consideration.

The court’s order aims to ensure that the RSS’s event is conducted peacefully and without unnecessary restrictions. The RSS had alleged that the police did not follow the Supreme Court’s guidelines while denying permission. With the court’s intervention, the RSS is likely to proceed with its Vijayadashami events as planned.
